Have been asked if Power of Attorney can be arranged online from UK to a person in Tenerife. The person they want to give the authority to is over here on regular visits and can take care of their friends affairs if they need to.

Don't know about online, but I believe there is a way of doing this through a notary in the UK.. At least, that's what I was told by Tenerife Property Shop when I was trying to buy an apartment through them - there were constant delays as the vendor was terminally ill and the notary was supposed to be visiting him in hospital.....

I think the lady has been told she can download the correct forms/documents and get them witnessed so they can be sent in the post, due to a car accident she is unable to get out and at the moment is in a wheelchair. I am looking for her online but just wondered if anyone has done a Power of Attorney without having to physically go to Solicitors etc... Her close friend is happy to come over here to sort out some financial matters for her but will need P of A to do this.

I wouldn't have thought it was possible, Suej, because the notary has to verify that the person signing the Power of Attorney really does want to do it (of sound mind, etc.) and also that they really are who they say they are. Might be quite dangerous if people could do this online .. identity theft and all that. I wonder if the Spanish Consulate in London can advise? We found them very helpful when preparing to move out here.

I have done one recently in Tenerife you do need a notary I am afraid. I am in the process of doing one myself in the UK with the link above thats quite easy, so unless you can get a notary in the UK, I don!t know what you can do about a Tenerife power of attorney.

It is better to deal with the notary in Tenerife, but you can discuss a power of attorney with a specialist English lawyer who can advise what is/is not possible. They are able to draw up documentation, but this would need to be translated etc.

You can have the UK power of attorney apostilled and legally translated into Spanish see here about apostilles make sure you include everybody's NIE or passport numbers and a notorised copy of the passport of the person giving the POA http://www.fco.gov.uk/en/about-us/what-we-do/services-we-deliver/legal-services/Legalisation/

I think, it is not possible to transfer power of attorney through on line. You need some physical medium for transferring it. Some type of registry etc and legal work would not possible considering Internet as a medium.

I very much doubt that you can do this online!

I used a power of attorney when I brought my apartment about 6 years ago.

If it has not changed you need a English solicitor who is also a Spanish Notary!

Once you have completed the forms you will need to visit English/Notary to sign them in his presence and then take them to The Foreign & Commonwealth office (it's at the end of the Mall near Admiralty Arch) so they can be verified.

I have on file all the details that were required (loads) if you need anymore info I can check my file and let you know.

I arrange PoA's on a regular basis for my clients in the UK purchasing property in Tenerife, very easy to arrange. First of all a Spanish Solicitor draws up the Power in English and Spanish and this is emailed in pdf to a uk Notary. The solicitor can be in the UK or Spain it doesnt really matter. There is at least 1 Notary office in every major UK Town, just google Notary and the Town nearest to the client. Arrange the appointment at the Notary for signing and client turns up and signs. The Notary then sends the Power to the Foreign office for the Appostile adding and then arrange for the Power to be sent to Tenerife by DHL or recorded delivery. Total cost is around £250 and time taken is about 2 weeks from start to finish including postage times.
