View Full Version : Motor cycle accident claim denied-》contacted by laywer

We had a motor cycle accident in La Orotava last summer, ambulance came, police report done, went to the hospital, filed a claim with Generali (fully insured), which was denied TWICE since no causing party could be identified. Now 4 months since the last communication from Generali, we were contacted by law firm operating from Santa Cruz.
They say that they have been appointed by Generali to handle our "reclamacion".
Is this standard procedure in Spain?
Why would Generali pay for a laywer to handle a claim on them, which they have already denied twice?

If I were You, I would contact the insurers Generali and ask what and why they are doing and are this Company acting on their behalf.

Sorry I have no idea about accident claims, but it must always be alright to ask.

Good luck to You both....

I will also ask a Friend if He can help....

Turns out that the law firm was appointed by Generali. Interesting approach.

Glad You posted. Are they now accepting the claim.?

This could affect any motorist if this is procedure.

Anyone any knowledge please.????

It seems they are only interested in any cost we might have had for rehab after the accident. We didn't look for any specific rehab, we just limped around for two weeks, slept poorly etc. We could argue that we missed out on vacation, I guess, but I don't have any "receipt" confirming that, if you understand what I mean 😀.?
Perhaps we'll argue that we couldn't benefit from our vacation as intended.

Many thanks for the Information.

I fell off a few times and needed a check by a Doctor.

My motor bike would also be damaged and need repairs?

Thankyou for the reply. Sorry noone has any information for You.

Did you insurance cover the damage on your bike? Ours didn't, but a Swedish insurance would. Seems that a Spanish "full insurance" is not worth much once an accident happens.

I was thinking of England/U.K. and the damage.

I had contacts and was able to repair it Myself, I was suggesting for You making a claim.

I know People hiring Cars must be careful with Insurance as it can cost a lot of money.

Best of luck to You.
